It is a Hanriot HD.1. This plane was used in several movies, including one starring Nungesser himself (The Sky Raider). The plane is still around, and is on display at the Planes of Fame Air Museum in Chino, California.

This aircraft happens to be Charles Nungesser's Hanriot HD-1, which he flew in America. The aircraft still exists and resides in the Planes of Fame Museum in Chino, California. Thanks to Thearodrome.com, where contributors found the solution.

The aircraft in the photo is actually a Hannover CL.II from 1917. The CL.II did not have the enlarged ailerons on the upper wing, unlike the pronounced step of the CL.III.
