    This is strange. The copyright notice on the right says, "No known copyright restriction". Instead, if you follow the link above, you get to the hi-res version of the picture, which has an evident copyright notice.
    Maybe is just the small-size version to be unrestricted?

    Yes. He was Shackleton's photographer (and I seem to remember reading a quote somewhere about Shackleton deserving Hurley the way Scott deserved Herbert Ponting... Will have to look for it.)
